I kinda got chunked under the bus on this one. My x girl friend who i have remianed friends with moved to destin and now has your house rented to some redneck yahoo in southaven who is behind on the rent. To make matters worse she used a realestate agent that was supposed to be manageing houses and the girl ran off the 1000.00 deposit and we do not have a copy of the rental contrac that was used. What do I have to do to get rid of his free loading ass?
I took him a notice to pay or quit today and he went nuts thought he was bout to get the old expandable baton used on him until he went back in the house and sent his old lady out with 300 bucks out of 1450.00
so experts what do we do to get rid of this yahoo?

You need to get an eviction notice drawn up. I think 30 days is what you have to give them. If they are not out in 30 days go to justice court and have them served to come to court.

Regarding the real estate agent, you need to file a complaint with the Mississippi Real Estate Commission (601-932-6770). The violation you stated is a license revocable offense and will not be tolerated by the RE Commission. If she wants to keep her license, she may be willing to pay damages and handle the tenant for you. If she works under a broker, they will be responsible as well (which is one reason why I rarely have any agents).

Ok, you are saying that the agent took off with the $1000 deposit and the contract? Does your ex still have a copy? PM me the agents name/company and I'll see if I can't get you in touch with the appropriate chain of command. Cotten has given you some good advice, and I'd report it after giving the appropriate broker an opportunity to handle it for you.

You are sort of in a rock and hard place. The rental agreement should cover terms of what happen when they are behind on the rent, but, you don't have it. It will take time to go through the Justice Court. Talk with the Justice Court clerk and start the process and follow it just as they tell you. If you miss a hoop you have to start over.

this realestate agent evidently did this to several other people and she has had her license in tn and ms revoked.
the problem is tiffany never got a copy of the lease.
i have given the guy a 3 notice to pay or quit yesterday. He wadded it up and throw it on the ground.
what does it cost to have a jaw and a leg broken these days?

I have rental property. In Mississippi, the quickest you can evict someone is 30 days. The law says 30 days if you have no lease or a month to month lease. If there was a signed agreement whether you have a copy of it or not....you have to go by the agreement. The renter may have a copy of it. Do what was said above though....if you were using an agent, they are responsible and the office they work through is responsible.......they have insurance for those types of things. If no one has a written agreement, then you go to the Justice Court and file for eviction and they will give the renter 30 days. Get them out of there if they act like that even if he tries to pay up to date.

its 30 days and then have him escorted off by sheriff. if you go to court(my dad just went through this ) you dont get late fees and contempt wont hold up get him evected and cut your loss

I just took off both exterior doors and it took care of my problem in two days. I didn't have enough patience to wait one more day much less 30. These were crackheads though.

Funny thing. The old man had a trlr park and evicted a few over the years. It was a 3 day deal cost $40 and the cops threw'em out. Couple of times the judge garnished their wages to recoupe some rent. Maybe they do things differently in Biloxi... At first he thought it would be a hassle and hated to do it. Nuttin too it! Kinda plumbed the rest of'em up for awhile. A good "rental application" with references, job, rules, etc. was what the old man screened'em with.

I have several pieces of property. Question, Is he a dead beat or is he having a hard time. If he is a dead beat get him out ASAP. If he is having a hard time but he is honest, jack his rent up a bit to cover your time and work with him on a weekly or bi weekly basis. There will be some money lost in repainting / repairing the property and some time to sit vacant before renting it again if you kick him out not to mention court costs. I have seen both types of people. Some set out to screw you and others just can't manage money. Best of luck.

if he was not beligernt and a ass I would be more than happy to work with him. but to tell your landlord on teh phone to come on over and you will "take care of you" does not cut in my book. Not to mention you are a month behind on the rent
