Sorry man....was just calling it like I saw it and with what knowledge I have been given......but I can see how it probably would, ultimately, be tough to litigate, judging by the letter of the Act and what it is meant for, the comment or conversation in question was probably in violation, but whether or not it is arguable in court or not is probably another story......Relentless wrote:olemissduckhunter wrote:
That my friend IS THE DEFINITION of a HIPAA violation.....Take it from someone who is in nursing school and gets blasted with HIPAA rules every day of the week
Yeah I am a hospital administrator...the ones that fire the nurses that were drilled everyday all week...I just walked down the hall and asked our in house attorney. He said that's a pretty grey area...because it depends whether he was on duty, whether it was common knowledge, what details were revealed....basically he said that would be a tough battle.
He had a hard time following when I said, well this guy Hammer, screwed up and said something to Snot about some brothers accident where they fell out of a treestand....and now theyre all suing eachother....and oh yeah this is all on the internet. But back to the task at hand....I just wanted to point out that theres a large amount of holes in suing that EMT for a HIPAA violation.
back to the regular scheduled program sorry
Anyway......while we are on the subject.....got any openings in yall's SICU??
