Your mistaken, at least in Mississippi. They interpet the laws a little differnt in LA i do believe. In MS, you can legally hunt, wade, swim naked, whatever, inside the natural banks of a public waterway. But being legal and getting run off by a pissed off landowner are two different things. Just gotta show some respect in certain situations.

Well this is what happened. I was deer hunting and watched a guy come in by boat until he ran out of water, he then got out of the boat and walked across the ridge about 150 yards where there was a break in the timber and another slough. Thats where he threw out his dekes and hunted. I see a couple of issues (1) navigable water, (2) natural bank, (3) he crossed dry ground on foot.
Yeah the water was navigable, in an airboat. It wasn't on the cut bank so there is no clear definition of "bank". The River was at 24', which is around normal for this time of year and definitely not floodwaters, so I could see the argument for being within the natural bank. But the guy didnt just drive the boat up to the spot he was hunting, he had to cross dry ground to get there. That is what I consider trespassing.
Personally, I dont care. It was entertaining and what few shots he took got the deer moving. I bowfish, so I'm an advocate of public water rights, but in my eyes this was a clear case of trespass.
