closing attorney outbid me

Gentlemen,
I found some unlisted delta property with a great history of holding ducks. I contacted the absentee landowner and we reached an agreeable sales price. I brought the transaction to a local Boliver co. law firm for the closing. At first the attorney seemed keen to close the deal. Then two days later he calls me and says he cant recommend I purchase the property because the title isnt clear. Then I foudn out on Friday that he went around me and is in the process of buying the property for himself. Im furious to say the least. Do I have any recourse? I've thought about contacting an experienced litigator in Jackson but I don't want to waste time and money if I ultimately have no recourse.

Seems to me he used his influence. No matter what, people like this man will reap what they sow.

If you can prove that he influenced you to not purchase then signed a contract to purchase yes you have recourse.

You didn't get outbid, you got screwed. Dollar to donuts i bet i could name who in less than 3 guesses. If you've got proof, go after him and let him buy it for you.

If I were you, I would go find a nasty plaintiff attorney with a track record and go after him. Look around the Delta; Clarksdale, Greenwood, etc... There are a few really good ones. Do you have any documentation?

Exact same thing happened to me on a piece of property near Hillside Refuge....the Holmes County lawyer emailed me, and said title was not clear, and for me to back out of the purchase....he bought it out from under me in less than a week.
I had everything documented(emails and texts), and was going to nail his aazz to the barn door, but later found out he was kinfolks with one of my hunting buddies.

I would definitely report this to the Ms bar assn. Not sure what they would do, but I would think that would be viewed as highly unethical. Go sit down with someone in lieu of calling or emailing.

Were you borrowing money to finance the purchase?
(Even if he was the closing attorney for the bank, there could be a claim for tortious interference with a contract.)
Did the attorney provide you with a title certificate or title opinion?
If so, did he explain what it would take to clear up the title problems?

+ 1 on this, and file a grievance against him with the bar association. That will keep him out of ANY duck hole for quite some time.

Wouldn't matter to me if the fella was my uncle. Sorry is sorry and I'd see it as doing him a favor to knock some sense back into him.

BAR association probably wouldn't be very happy with him I wouldn't think.
